E signatures can be used on tenancy agreements

Landlords and Agents will be pleased to hear that a recent County Court decision has upheld the use of an electronic signature in an Agency Agreement.
The case involved south-east Wales agents Roberts and a tenant's guarantor in a case involving rental arrears. The guarantor tried to dispute her obligation to pay the rent arrears owed by the tenant of nearly £4000. She argued that her digital signature did not match her regular signature when signed on paper.
However the Judge dismissed this argument saying that digital signature's often look different because of the technology used. Once the Judge had seen the email trail and the guarantor's application form he ruled in favour of the Agent.
The using of digital signatures on Agency agreements is becoming more common and is especially useful for student contracts where the guarantor often lives some distance from the landlord or Agent.
